By creating an account and using the PET@ platform ("PET@", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the platform. These Terms constitute a legally binding agreement between you and the data controller, SIA PRIMILESSA.
To create an account on PET@, you must confirm that you are at least 13 years of age. If you are under 18, you must obtain the consent of a parent or legal guardian before using the platform. By registering, you confirm that you meet these eligibility requirements.
You are responsible for maintaining the accuracy of the information provided during registration. You must provide a valid email address and create a pet profile to access core platform features. You are responsible for safeguarding your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
You retain all rights to the content you upload to PET@, including pet photos, descriptions, and other materials. By uploading content, you grant us a non-exclusive, worldwide, royalty-free, revocable licence to store, display, and distribute your content within the platform in accordance with your privacy settings. You represent and warrant that you have the legal right to upload all content and that it does not violate any third-party rights, including intellectual property and privacy rights.
You agree not to upload or share content that is illegal, harmful, threatening, abusive, defamatory, or that infringes on the rights of others. We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.
You agree to use PET@ only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use and enjoyment of, the platform by others. You agree not to:
You are solely responsible for the accuracy, completeness, and truthfulness of all information you submit about your pet, including species, breed, age, health data, vaccination records, identification numbers, and pedigree information. PET@ does not verify, validate, or guarantee the correctness of any user-provided information and shall not be held liable for any consequences arising from inaccurate, incomplete, or misleading data.
PET@ offers both free (Basic) and paid (Premium) subscription plans. Premium features are available only to users with an active paid subscription. Subscription fees are billed through our payment provider (Stripe) on a recurring basis. You may cancel your subscription at any time, and access to Premium features will continue until the end of the current billing period. Fees are non-refundable except as required by applicable law.
PET@ includes social features such as Find Friend, Find Partner, Groups, Forum, and Activity Feed. You are responsible for your interactions with other users. We do not endorse or verify the identity of users. You use community features at your own risk. We reserve the right to moderate, remove, or block content and users that violate these Terms or community guidelines.
The Lost & Found feature allows users to post reports about lost or found pets. Contact information provided in these reports will be publicly visible to facilitate communication between users. You are responsible for the accuracy of the information you post and for managing your own communications with other users regarding lost or found pets.
The PET@ platform, including its design, features, logos, and content not provided by users, is the intellectual property of SIA PRIMILESSA and is protected by applicable copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from the platform without our prior written consent.
Your use of PET@ is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the platform, you consent to the data practices described in the Privacy Policy.
PET@ is provided on an "as is" and "as available" basis. We do not guarantee that the platform will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any damages arising from your use of, or inability to use, the platform.
To the fullest extent permitted by applicable law, SIA PRIMILESSA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, income, or goodwill, arising out of or related to your use of the platform. Our total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount you have paid us in the preceding twelve (12) months.
You agree to indemnify and hold harmless SIA PRIMILESSA, its officers, employees, and partners from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your infringement of any third-party rights.
You may delete your account at any time through the platform settings. Upon account deletion, your personal data will be securely deleted or anonymised in accordance with our Privacy Policy, except where retention is required by law.
These Terms remain in effect while you use the platform. We may suspend or terminate your access to PET@ at any time, with or without cause or notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the platform ceases immediately.
We may update these Terms from time to time. Significant changes will be communicated via email or through the platform. Continued use of PET@ after changes constitutes acceptance of the revised Terms. The "Last updated" date below indicates when these Terms were last revised.
These Terms are governed by the laws of the Republic of Latvia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the platform shall be resolved in the courts of Latvia, unless otherwise required by mandatory consumer protection laws.
